Conditions of use

The access and/or use of this SURO website automatically gives you USER status, which means that by accessing and/or using the website you accept the General Terms of Use stated here. If you do not accept these terms please do not use this website.

Intellectual and Industrial Property

https://suroswimwear.com allows access to the User to online information, products, services and data (from now on these will be referred to as CONTENT) which are SURO´s property or its licensers´ property.

SURO is the owner of all intellectual and industrial property rights of its website, as well as all its CONTENT (images, sound, audio, video, software, texts, brands, logos, colour combinations,  structure, design, selection of materials used, computer programs used to sustain the website and its use and access, etc.) All rights are reserved. In appliance with articles 8 and 32.1, second paragraph, of the Intellectual Property Act, the reproduction, distribution and pubic communication of all or part  of the CONTENT of the website with commercial objectives is strictly forbidden in any way or technical capacity without SURO´s authorization.

The USER will respect the Intellectual and Industrial Property rights of SURO. The USER is allowed to view the website´s CONTENT, copy it, or save it in a hard drive or other devises as long as it is only for personal and private use. The USER will not alter, delete or manipulate the protection devices or security systems which may be installed in SURO´s website.

SURO has the right to carry out without any notice any changes to the website that may be necessary, therefore SURO can change, delete or add any contents or any services to the website.

suroswimwear.com is directed to individuals of legal age who have full legal capacity to act accordingly to its use. Minors are not permitted to use the Web site and should not, therefore, use the services of the Web.  SURO reserves the right to cancel the data of those users who, having been required to do this, do not provide SURO with satisfactory credentials to prove their age.

Obligations of the Users

The USER accepts his or her responsibility for the right use of the website. This responsibility means the USER needs to comply with the necessary register requirements that may be necessary to access certain services or contents. During the register process the USER will provide correct legal information. As a consequence of this register, the USER will be given a password. The User is obliged to use the password in a confidential and secure way. The USER will responsibly use the website and its CONTENT and under no circumstances will use SURO´s services and CONTENT to do any of the following: 

  • Carrying out any illegal activities or any activities that may disturb public order.
  • Promoting or distributing any information or propaganda that advocates terrorism. or is illegal,  racist, pornographic or goes against human rights.    
  • Damaging SURO´s hardware and software systems, or their providers´ or any other 3rd parties´ involved, as well as distributing computer viruses or any hardware and software systems that may provoke any of the damages mentioned above.
  • Trying to access or use the email addresses of other users and changing or manipulating their messages.

SURO has the right to delete any offensive comments and posts that may damage or go against children´s rights or anyone´s dignity or that are discriminatory, racist, pornographic, or go against public security and order, or are not considered appropriate for their publication.   In any case, SURO is not responsible for the opinions of any of the users which may be posted in any social media platforms.


Personal data protection

In the treatment of the personal data of its users, SURO complies at all times with the legislation in force in Spain and in the European Union and in particular with Regulation (EU) 2016/679 of the European Parliament and of The Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “GDPR”). SURO also complies wih the Organic Law 15/1999, of 13 December, of Protection of Data (hereinafter "LOPD") and its implementing regulations. Also, SURO complies with the Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (hereinafter, "LSSI").

To do this, SURO adopts the technical and organizational measures necessary to prevent the loss, misuse, alteration, unauthorized access and theft of the personal data provided, taking into account the state of technology, the nature of the data and the risks to which they are exposed.

SURO complies with the Protection of Personal Data Act, L15/1999 December 13th, and with the RD Act 1720/2007, December 21st, where we find all the relevant regulations regarding the correct use of the USER´s personal data. For this purpose, next to every questionnaire asking for personal data SURO will inform the USER of the DATA protection conditions and will ask the USER to accept these conditions. The USER will be informed of his/her access and cancelation rights, as well as SURO´s responsible use of the data and the conditions of passing information to third parties.  

SURO will ask the USER permission to use his/her email address for commercial purposes, according to the L34/2002, July 11th, of Electronic Commerce and Information Services.

Access to the Website

SURO will not be responsible for any damages caused by the following: errors or omissions in CONTENT, lack of access to the website, virus transmission or transmission of damaging computer programs, in spite having taken all necessary measures to avoid this, as well as the bad functioning of the web browser or any versions of the browser that haven´t been updated.  .

Cookies

SURO´s website stores information of the IP addresses of the computers that connect to the website through the use of cookies, or small text archives which contain information and are sent to the USER´s computer when it connects to the website.   

Cookies are used as a tool to improve navigation and to adjust it to the USER´s necessities and tastes, by analysing the statistics of internet which are provided.

If there are any links or hiperlinks in suroswimwear.com SURO will not have any control over these websites and their content. SURO will not be responsible for the contents of any of the links of external websites nor,  their quality, technical availability, veracity, validity, accuracy, reliability and legality of any of these hiperlinks or any other websites. The inclusion of any of these external links will not imply SURO´s association, partnership or collaboration with any of the connected entities. We encourage users to be aware of the fact that when you use one of these hyperlinks are abandoning our Web site and you should read and review the general terms and conditions and the privacy policies of those other sites.

Exclusion of guarantees and responsibility for the operation of the Website and its services

SURO does not guarantee the availability and continuity of the operation of the Website and its services. SURO will warn with sufficient notice of the disruptions that could happen in the operation of the Web Site and its services whenever possible.

SURO, or its server may not be free of viruses, errors, spyware, Trojans or similar malicious software. SURO is not responsible for any damage to hardware or software of your computer and other technology.

SURO is excluded from, with all the extension permitted by the legal code, any responsibility of the damages of any kind that may be due to the lack of availability or continuity of the operation of the Website and its services, or the missuse of Suro’s services that other users may attribute to the Website and its services, on other users, although not exclusively, to failures in the access to the different web pages that configure the Web site.

Exclusion of guarantees and responsibility for the use of the Web Site, its services and contents by the Users

SURO does not guarantee that users use the services and contents of the Web Site in accordance with these Terms of use and with the particular conditions of application, nor that they do so in a diligent and prudent way. SURO does not guarantee the truthfulness of the data that Users provide about themselves in their area of registration. SURO excludes any liability and, in particular, although not exclusively, for damages of any nature that could be due to the impersonation of the personality of a third party made by a user in any kind of communication made through the Web site.

SURO has the right to deny access to the website and/or to the services offered by Suro, without a previous notice to those users who do not comply with the current General Conditions of Use.

SURO will take legal action against anyone who violates the terms and conditions and to anyone who carries out an illegal use of the website.

SURO will be able to modify at any time the conditions in this document, and will publish them accordingly. These conditions will be valid until new ones are published. 

Spam

SURO does not approve the use of SPAM as a marketing tool. For this reason, SURO will not carry out massive mail outs and will not send unsolicited messages to people with no previous contact or to those who have expressed their wish not to receive these messages.  

When SURO believes certain information may be of interest for certain users, SURO will have the right to send them this information having asked the users first if they accept the conditions and always offering them the option to stop receiving notifications at any time.
